Account Terms and Conditions

This Agreement is between Gulfcoast On-Line Development, Inc (GOLD Inc) and the Customer (as defined by the GOLD Inc Online Registration Form) for Internet dial-up services. Customers agree to abide by the following:

1. Acceptable Use Policy

Please read this carefully. Failure to adhere to these terms may result in cancellation of your account. Similar restrictions are used by all Internet Service Providers.

If you are new to the Internet and do not fully understand these points, please call GOLD Inc.

a. GOLD Inc customers will not send unsolicited e-mail. Unsolicited e-mail is defined as any e-mail sent to an individual or group (whether the mailing list was bought or developed by the Customer) where the recipient or recipients have not specifically requested information or a response. E-mail includes information of any kind, advertisements, literary works, graphics, voice and video files, and any other material that can be contained in current or future implementations of e-mail.

b. GOLD Inc customers will not post advertisements to USENET newsgroups unless the newsgroup specifically states in its FAQ that advertisements are acceptable.

c. GOLD Inc customers will not use their Internet accounts to harass or abuse other members of the Internet community

d. GOLD Inc customers will not post copyrighted materials, whether written, graphic, or in any other form, to any public site without permission from the author or creator.

e. GOLD Inc customers will not use their accounts to initiate any process intended to discover passwords, take others' mail, or decrypt others' information, nor will they attempt to obtain unauthorized access to any computer or computer network.

f. GOLD Inc customers will not use their accounts for any unlawful purpose.

g. GOLD Inc reserves the right to suspend or terminate any account, at any time, for use considered unacceptable at the sole discretion of the GOLD Inc System Administration.

h. GOLD Inc reserves the right to cancel access to service for customer's account(s) if customer's consumption of GOLD Inc's resources exceed the reasonable and customary use of the service.

i. A charge of $2.00 per hour shall be made for simultaneous use of dialup ports.

2. Account Information

The Service Begin Date is the day on which GOLD Inc activates the Customer's account. The first month's fee, as outlined in GOLD Inc's Registration Form, is refundable if the customer cancels within 10 calendar days of the Service Begin Date.

This service period extends for 1 month and is automatically renewed unless terminated by the Customer or GOLD Inc. GOLD Inc reserves the right to change its fees at any time. Fee changes take effect at the time of renewal. GOLD Inc reserves the right to terminate any account in violation of any term of this agreement.

Unlimited access is not meant to be a substitute for a dedicated line. After 10 minutes of inactivity, the line will be dropped. Dedicated lines are available upon request.

3. No Warranties

GOLD Inc does not warrant any connection to, transmission over, or the results of the use of any network connection. GOLD Inc assumes no responsibility for any damage, loss, or expense suffered by the Customer, including but not limited to loss of data, delays, non-deliveries, mis-deliveries, or service interruption caused by GOLD Inc or Customer error, omission, or negligence.

Use of this service and any information obtained using this service is at the Customer's risk. GOLD Inc does not accept any responsibility of the accuracy of, quality of, or actions taken in response to the information obtained through its services.

4. Use of Service

This service may be used only for lawful purposes. The transmission of information in violation of any local, state, federal, or international regulations is prohibited. This includes, but is not limited to, copyrighted, obscene, or threatening material, and material protected by trade secrets. The Customer agrees to indemnify and hold harmless GOLD Inc for any claims that arise from the Customer's use of the service.

GOLD Inc customers will be responsible for all use of their account and confidentiality of password(s). GOLD Inc will suspend access or change access to accounts immediately upon notification that his/her password has been lost, stolen or otherwise compromised.

All services provided by the Customer either in part or in total using GOLD Inc's connection are subject to relevant local, state, federal, and international regulations. If GOLD Inc or other relevant authorities determine inappropriate usage of this service, GOLD Inc reserves the right to suspend or terminate the service immediately and without notification.

5. Service Coverage

This Agreement extends service to the Customer only, and not to any other organization or entity affiliated with the Customer. The Customer cannot resell Internet connections, or transfer the account to another individual or group.

GOLD Inc customers are responsible for all local or long-distance telephone charges for connecting to GOLD Inc.
